General Terms and Conditions of SK Shapes GmbH

Represented by its Managing Director, Stan Keusch.

All business transactions and deliveries by SK Shapes GmbH are exclusively governed by these General Terms and Conditions, which form an integral part of all contracts concluded with us (including online orders).

Prices, Payment, and Shipping

Goods will only be shipped upon receipt of full payment into our designated bank account. Product collection is only possible upon presentation of proof of full cash payment or advance payment. Delivery of goods will only occur after the completion of the necessary production process.

Packaging and shipping costs, as well as the associated risks, are the responsibility of the customer. By placing an order, the customer acknowledges that they have ordered a handmade product which will be produced or enter the production cycle after the order is received. In the event of a longer delivery period, the customer will be informed of the estimated delivery time upon order confirmation and accepts this timeframe with payment.

Warranty, Risks, and Limitation of Liability

The statutory warranty provisions of Swiss law shall apply.

Products sold by SK Shapes GmbH are designed for experienced users. The customer is solely responsible for ensuring they possess the necessary skills and level of experience to safely operate these products. The sports associated with these products, including but not limited to kitesurfing, inherently involve risks of serious injury, permanent disability, or death. SK Shapes GmbH assumes no liability for damages or injuries resulting from the use of its products under any circumstances.

The warranty covers manufacturing defects and material deterioration of components beyond normal wear and tear. SK Shapes GmbH reserves the exclusive right to decide on the replacement of damaged parts following examination, and the customer shall bear the return shipping costs. This warranty applies only to the original purchaser and does not extend to second-hand sales of SK Shapes products. Products can only be purchased directly from SK Shapes GmbH.

Jurisdiction and Applicable Law

These General Terms and Conditions shall be governed exclusively by Swiss law. The place of jurisdiction shall be Bern, Switzerland.

Right of Withdrawal

For delivered products without damage attributable to SK Shapes GmbH, the right of withdrawal is excluded. Upon request, customers can be informed about the production process through photos and email to prevent potential misunderstandings. The customer has the right to revoke their order within 10 days of receiving the order confirmation.
